When you require medical leave to deal with a “serious health condition” or to assist a sick spouse, parent or child with their own care, under certain circumstances the law prohibits your employer from firing you for taking such leave.

If you are eligible for FMLA leave, you may be entitled to up to twelve (12) weeks of family leave and twelve (12) weeks of medical leave each year. Unless there is a company policy that allows for paid leave, FMLA is typically unpaid.

Once your FMLA leave period is over, you are usually entitled to either return to your previous job or to an equivalent job. When possible, an employee is required to provide reasonable notice of his or her anticipated need for leave.

If you believe you have been fired or suffered an adverse employment action in violation of your rights under the Family and Medical Leave Act, call Silver & Silver today for a free consultation at 610-638-7255.
