Has your Social Security Disability claim been denied? Don’t give up yet!
It can be deeply frustrating to be unable to work yet still have your claim for benefits denied. While the disability appeals process can be lengthy and at times exasperating, many claimants find success in the appellate stages.
At Silver & Silver, we understand that most initial applications for Social Security Disability and SSI benefits are denied. We are committed to doing everything in our power to transform your denial into an approval.
If your claim is denied at the initial stage, there are up to four levels of appeal available:
- Reconsideration: Your claim is reviewed anew by someone who was not involved in the initial decision. Both the original evidence and any new information you submit are considered.
- Hearing by an Administrative Law Judge (ALJ): In the Philadelphia area and South Jersey, hearings usually occur in the Social Security Administration offices in Center City Philadelphia, Elkins Park, and Pennsauken, NJ. Most cases we handle are approved at this level.
- Review by the Appeals Council: If the ALJ denies your case, the Appeals Council of SSA can review the decision. They may also send your case back to an ALJ for another hearing.
- Federal Court Review: If the decision by the Appeals Council is still unsatisfactory, you have the right to file a lawsuit in the Federal District Court. Representation by an attorney admitted to practice before the U.S. District Court in Pennsylvania or New Jersey is required at this level. Silver & Silver handles many such claims in District Court and will always review your claim for possible District Court appeal if warranted.
Remember, once your benefits are denied, time is of the essence. It’s crucial not to miss the appeal deadline!
The Administrative Law Judge Hearing Process
The hearing is often the most critical stage in your case. It provides the unique opportunity to present evidence in person and directly interact with the decision-maker. Being well-prepared is key, as this process can seem intimidating at times.
Here’s how Silver & Silver can assist you at a hearing before an Administrative Law Judge (ALJ):
- Analyze and bolster your Social Security claim file.
- Prepare and strategize your case for success.
- Obtain and organize medical evidence from your healthcare providers, including detailed narratives and necessary medical source statements from your medical specialists.
- Make strong and legally grounded arguments to the ALJ
- Prepare you and your witnesses for effective testimony.
- Cross-examine any medical and vocational experts present at the hearing.
Social Security often relies on expert testimony from medical and vocational professionals. We have the expertise to present your evidence effectively and challenge these experts to maximize your chances of success.
